3. Scope and acceptance

3.1 These Terms govern the use of the Website and the Services, both free and paid. Browsing the Website constitutes acceptance of the rules of use they contain; creating an Account, publishing a Notice and any order require express acceptance, by the checkbox provided for that purpose.

3.2 The Death Notice Pack is further governed by the Subscription Terms, and refunds by the Refund Policy. The processing of personal data is described in the Privacy Policy. These documents are accessible from the footer of every page of the Website.

3.3 Funerar may amend these Terms. The version applicable to an order is the one accepted at the time of that order. A material change is announced on the Website or by email before it takes effect.

4. What the Services are

4.1 Funerar is an online register of death notices. It allows you to:

  • search for and view published Notices free of charge, without an Account, by department, town, name or date;
  • leave a Tribute on a Memorial page free of charge;
  • compose and publish a Notice on the register free of charge, without a means of payment;
  • optionally order, for a fee, one or more Press publications of that Notice;
  • subscribe to the Death Notice Pack to customize the Memorial space and send announcement cards by email;
  • consult the Directory of funeral professionals.

4.2 Funerar is not a civil registry service. A Notice is not an official act, does not prove a death, and does not replace any declaration or formality with an administration, a notary or any other body.

4.3 Funerar is not a funeral services company and does not organize funerals. The Directory is compiled from the public business register (SIRENE); the presence of a professional in the Directory is neither a recommendation nor a guarantee of their services.

4.4 The register may include Notices drawn from the file of deceased persons published by INSEE: name, first names, dates of birth and death, and town. Deaths appearing in the associated opt-out file are excluded. A family wishing to have such a Notice removed may request it at any time (Article 6.7).

5. Account and login details

5.1 Consulting the register and leaving a Tribute do not require an Account. Publishing a Notice, ordering a Press publication and subscribing to the Death Notice Pack do require one.

5.2 The Account is reserved for adults. The User provides accurate information and keeps it up to date, in particular their email address, to which confirmations and invoices are sent.

5.3 Login details are personal and confidential. The account holder is responsible for any action performed from their Account and must inform [email protected] without delay of any unauthorized use.

6. Publishing a death notice

6.1 Publishing takes a few steps: details of the deceased, drafting the Notice, optional choice of Press publications, then validation. Where no Press publication is chosen, the Notice is published on the register free of charge, immediately after validation.

6.2 By publishing a Notice, the Publisher warrants that:

  • they are a relative of the deceased, or a professional mandated by the family, and are entitled to announce this death;
  • the information published is accurate and the death is real;
  • the living persons named in the Notice — family members, close relations — do not object to being named;
  • the Notice contains no insulting, defamatory, discriminatory or public-order-violating remarks, and no information they are not entitled to make public.

6.3 Funerar does not systematically review Notices before they go online. It may ask the Publisher for supporting documents, and may refuse, suspend or remove a Notice that does not comply with these Terms or whose publication is reported to it as unlawful or not authorized by the family.

6.4 A published Notice is public: it can be viewed by any visitor and may be indexed by search engines. The Publisher may indicate that the ceremony is being held in private; the location and time of the ceremony are then not displayed.

6.5 The Publisher may edit their Notice from their Account after publication. An edit has no effect on a Press publication already sent to the newspaper.

6.6 The religious or secular symbol optionally chosen for the Notice is displayed on the Memorial page and, for a Press publication, sent to the newspaper. It is optional.

6.7 To remove a Notice from the register, the Publisher — or a relative of the deceased for a Notice they did not publish — writes to [email protected] stating the address of the Memorial page. Deleting the Account also results in the deletion of the Notices attached to it, under the terms of the Privacy Policy.

7. Photos and published content

7.1 The Publisher may upload photographs (JPEG, PNG or WebP formats, 8 MB maximum per file) for the portrait, the cover and the gallery of the Memorial space, as well as texts.

7.2 The Publisher warrants that they hold the necessary rights to each photograph and each text, and that recognizable persons in the photos do not object to their dissemination. They indemnify Funerar against any third-party claim in this regard.

7.3 The Publisher retains their rights in their content. They grant Weeleaks Technology Limited (C 116871) a free, non-exclusive licence to host, reproduce and display it on the Website, for the sole duration of its online publication and for the sole needs of the Services.

7.4 Uploaded photographs are served from a public address: they are visible to anyone who views the Memorial page. The Publisher may remove a photo from the gallery at any time from their Account.

8. Tributes, moderation and reporting

8.1 Any visitor may leave on a Memorial page a candle, a flower, or a written message of no more than 2,000 characters, stating their name and, if they wish, their email address. The number of Tributes that can be left from the same connection is limited, to prevent abuse.

8.2 Candles and flowers are displayed immediately. A written message is never published directly: it remains pending until the Publisher of the Notice approves it. The Publisher may also refuse it or mark it as unwanted, and disable Tributes on their Memorial page.

8.3 The author of a Tribute is solely responsible for its content. Insulting, defamatory, hateful, discriminatory or threatening remarks, infringements of privacy, advertising, commercial links and any unlawful content are prohibited.

8.4 For Memorial pages, Funerar acts as a host of the content published by Publishers and Tribute authors. Any manifestly unlawful content may be reported to [email protected], stating the address of the page, the content concerned and the reason for the report. Content whose unlawfulness is established is promptly removed.

8.5 An author who wishes to remove their own Tribute writes to [email protected] from the email address given when it was left, or provides the details needed to identify it.

9. Press publication

9.1 Where newspapers are offered for the department concerned, the Publisher may order the Press publication of their Notice in one or more of them. The price depends on the newspaper, the department, the date and the length of the Notice, estimated in lines according to the newspaper's layout rules, and on the frame chosen. It is shown inclusive of all taxes before payment.

9.2 After payment, the text of the Notice, the frame and the symbol chosen are sent to the newspaper by Funerar. No other Publisher data is sent to the newspaper.

9.3 Each newspaper applies its own editorial and layout rules. Funerar transmits the order in time for the requested date, but cannot guarantee either the newspaper's acceptance of the Notice or its publication on a specific date, which are for the newspaper to decide.

9.4 Where a publication does not take place, whether because it is refused by the newspaper or because transmission fails, the amount paid for that publication is refunded in accordance with the Refund Policy.

10. Memorial space and the Death Notice Pack

10.1 The Notice and its Memorial page are free of charge. Customizing the Memorial space and sending announcement cards by email are reserved for holders of the Death Notice Pack, a monthly subscription at €19,00 per month whose first month is free.

10.2 The Pack is attached to the Account: it covers all the Notices published from that Account. The announcement card is sent by Funerar, on behalf of the Publisher, to the email addresses they provide, up to 50 recipients per send and 200 per Notice.

10.3 The Publisher warrants that the recipients of an announcement card are persons from their circle or from that of the deceased, whom they are entitled to inform. Sending announcement cards for commercial purposes or to address lists is prohibited.

10.4 The terms of the subscription — free period, renewal, cancellation, and the fate of the Memorial space at the end of the subscription — are set out in detail in the Subscription Terms.

11. Price, taxes and payment

11.1 Free of charge: consulting the register, leaving a Tribute, and publishing a Notice on the register with its Memorial page. Paid: Press publications, per item, and the Death Notice Pack, by subscription.

11.2 Prices are shown in euros, inclusive of all taxes. The applicable price is the one shown at the time of ordering, before confirmation.

11.3 Payment is made by bank card through Stripe. Funerar never stores card details. An invoice is issued for each payment.

12. Right of withdrawal

Consumers in the European Union and the EEA

12.1 In accordance with Directive 2011/83/EU and Article L221-18 of the French Consumer Code (Code de la consommation), a consumer has fourteen (14) days from the conclusion of the contract to withdraw, without having to give reasons.

12.2 Press publication: a consumer who asks for their order to be sent to the newspaper without waiting for the end of the withdrawal period acknowledges this expressly when ordering. In accordance with Article L221-28 of the French Consumer Code, they lose their right of withdrawal once the publication has taken place. If they withdraw before the order is sent to the newspaper, they are refunded in full.

12.3 Death Notice Pack: access to the Memorial space is opened immediately at the subscriber's express request. As the first month is free, withdrawal during that period triggers no charge. Details are set out in the Subscription Terms and the Refund Policy.

12.4 To withdraw, it is enough to write to [email protected] from the email address on the Account, within the time limit. No particular form is required.

Professionals

12.5 No right of withdrawal applies to an order placed for professional purposes, including by a funeral services company.

13. Availability, liability and force majeure

13.1 Funerar endeavors to keep the Website accessible at all times, subject to maintenance operations and incidents affecting third-party networks and providers. The Services are provided under a best-efforts obligation.

13.2 Funerar is not responsible for the content of Notices and Tributes, for which their authors are liable, nor for the editorial decisions of newspapers, nor for the services of professionals listed in the Directory.

13.3 Except where the law prohibits it, the liability of Funerar in respect of an order is limited to the sums actually paid for that order.

13.4 Neither party is liable for a failure to perform due to a case of force majeure. Nothing in these Terms limits the rights that the law mandatorily grants the consumer.

14. Intellectual property

14.1 The Website, its interface, its texts, its illustrations and its trademarks are and remain the property of Weeleaks Technology Limited (C 116871) or its licensors. Any unauthorized reproduction is prohibited.

14.2 Systematic or automated extraction of Notices, of the Directory or of any other part of the register, and their reuse for commercial purposes, are prohibited.

15. Personal data

15.1 The personal data of Users, and that of relatives named in Notices, is processed in accordance with the Privacy Policy and with Regulation (EU) 2016/679.

15.2 A Publisher who includes third parties in a Notice or sends an announcement card is responsible for the lawfulness of that information and of those sends with respect to the persons concerned.

16. Suspension and termination

16.1 Funerar may suspend or close an Account, and remove the content attached to it, in case of fraud, non-payment, publication of an unauthorized or false Notice, or breach of Articles 6, 7, 8 or 10.3 — immediately where the breach is serious or unlawful.

16.2 The User may close their Account at any time, from the website's data erasure request page or by email to [email protected]. Any ongoing subscription must be cancelled beforehand.

17. Governing law and disputes

17.1 These Terms are governed by the law of Malta, without prejudice to the mandatory provisions protecting the consumer in their country of residence, in particular French law for a consumer residing in France.

17.2 Any complaint must first be sent to [email protected]. Most difficulties are resolved this way within a few days.

17.3 Failing an amicable resolution, the consumer may, free of charge, refer the matter to a consumer mediator under Articles L611-1 et seq. of the French Consumer Code (Code de la consommation), or contact the European Consumer Centre in their country. The European Online Dispute Resolution platform was closed on 20 July 2025.

17.4 Failing an amicable settlement, the dispute is brought before the competent courts, the consumer retaining the option of bringing the matter before the court of their place of residence.
