Refund policy
When a payment made on Funerar — a press publication or the Death Notice Pack — can be refunded, and how to request it.
1. Who refunds, and what this policy covers
1.1 The Services sold on https://www.funerar.com are provided by Weeleaks Technology Limited (C 116871), . Billing questions are handled by Funerar.com at [email protected].
1.2 This policy covers the two paid items on Funerar: press publications, paid per item, and the Death Notice Pack, a monthly subscription at EUR 19.00 whose first month is free. It supplements the General Terms and Conditions and the Subscription Terms.
2. The principle
2.1 Publishing a notice on the register, its memorial page and leaving tributes are free of charge: nothing is charged, and there is nothing to refund.
2.2 A press publication is a service carried out by a newspaper on a given date. Until it has been sent to the newspaper, it may be cancelled and refunded; once published, it has been delivered.
2.3 For the Death Notice Pack, a subscription period that has already begun is due; cancelling prevents the next renewal.
3. Right of withdrawal — consumers in the EU and the EEA
3.1 In accordance with Article L221-18 of the French Consumer Code (Code de la consommation) and Directive 2011/83/EU, a consumer has fourteen (14) days from the order or subscription to withdraw, without having to give reasons.
3.2 Press publication: a consumer who withdraws before the notice is sent to the newspaper is refunded in full. Having expressly requested that their order be carried out before the end of the period, they lose their right of withdrawal once the publication has taken place, in accordance with Article L221-28 of the French Consumer Code.
3.3 Death Notice Pack: access to the memorial space is opened immediately at the subscriber's express request. As the first month is free, withdrawal during that period triggers no charge. A consumer who withdraws within fourteen days of a first charge is refunded, less, where applicable, an amount proportional to the service already provided for the period paid.
3.4 To withdraw, write to [email protected] from the email address on the account, within the time limit. No particular form is required.
3.5 An order placed for professional purposes, including by a funeral services company, does not benefit from the right of withdrawal.
4. Free month and cancellation
4.1 The card is registered at subscription but is not charged during the free month. Cancelling before the end of that month avoids any charge.
4.2 After the free month, the subscription can be cancelled at any time from the Billing page of the account. Cancellation stops the next renewal; it does not refund the current period, and access to the memorial space continues until the end of that period.
5. Press publications
5.1 A publication cancelled by the customer before it is sent to the newspaper is refunded in full.
5.2 A publication refused by the newspaper, or that could not be sent to it, is refunded in full, without the customer having to request it as soon as Funerar becomes aware of it.
5.3 A publication run on a date other than the one requested, due to the newspaper, is reviewed case by case; the customer is invited to write to [email protected].
5.4 A publication run as ordered is not refundable. An error in the text supplied by the customer does not give rise to a refund; an error attributable to Funerar or to the newspaper is reviewed and, if established, refunded.
6. Other cases of refund
6.1 Apart from the right of withdrawal, Funerar refunds:
- a double charge or any other billing error;
- a charge made after a cancellation that was validly recorded;
- a payment the card holder did not authorize;
- a subscription period during which the memorial space was unavailable due to Funerar, pro rata to the unavailability.
7. What is not refunded
- a subscription period that has already begun, once the right of withdrawal has expired;
- a press publication run as ordered;
- the consequences of inaccurate information provided by the customer;
- an account closed for serious breach of the General Terms and Conditions, in particular for publishing an unauthorized or false notice.
8. How to request a refund
8.1 Write to [email protected] from the email address on the account, stating the date and amount of the charge, the notice concerned and what you are requesting. A request that cannot be matched to an account and a transaction cannot be processed.
8.2 The request receives an acknowledgement of receipt and a reasoned response.
9. Processing
9.1 An accepted refund is made to the payment method used for the original transaction, within fourteen (14) days of acceptance. The time it takes to appear on your statement then depends on your bank.
9.2 A credit note is issued for each refund. Refunding a subscription period ends access to the memorial space for that period.
10. Disputing a charge with your bank
10.1 Writing to [email protected] is faster than a bank dispute and resolves most situations within a few days.
10.2 A dispute concerning a service that was actually delivered, raised without a prior refund request, will be contested with the bank using the order details.
10.3 This never prevents a card holder from disputing a payment they did not authorize; such a payment is refunded in accordance with Article 6.
